Frequently asked questions about cease-and-desist letters

What is a cease-and-desist letter (Abmahnung)?

A demand to stop a certain conduct, usually with a pre-drafted cease-and-desist declaration (Unterlassungserklärung) and a claim for costs. It is meant to avoid a lawsuit.

Should I sign the cease-and-desist declaration?

Not without checking it. Pre-drafted declarations often go too far and bind you with high contractual penalties. Have it checked first.

What happens if I let the deadline pass?

Then the other side can apply for a preliminary injunction or sue. That is usually much more expensive.

How much does the defence cost?

Basic €490, Plus €950, Pro €1,450, each plus VAT at a fixed price.

Who handles the defence?

An independent partner law firm specialising in trade mark, copyright and competition law. firma.de arranges it but does not provide legal advice itself.

Is the offer also available to private individuals?

No, the offer is for businesses.
